Definición de Visa O-1 y su base legal

La Visa O-1 también conocida como la visa de no inmigrante, está basada en personas que cuya destreza excepcional los hace elegibles para residir y trabajar de manera legal en los Estados Unidos, ahora bien, las habilidades deben ser absolutamente constatables.

Visa O-1A
La visa O-1A está basada en personas que poseen habilidades extraordinarias en los negocios, la educación, la ciencia y los deportes y que además tienen la oportunidad de trabajar en cualquier organización o compañía estadounidense.
por lo cual el postulante debe solicitar y tener una propuesta de petición de un empleador al interior del territorio nacional estadounidense, a fin de poder iniciar el proceso de obtención de esta visa, aunado a ello debe poder demostrar sus habilidades, presentar títulos, certificados o una prueba de otorgamiento de premios que demuestren sin lugar a error las destrezas y habilidades extraordinarias que posee, lo cual puede ser la demostración de su mérito nacional o internacionalmente en el campo específico en el cual se desenvuelve.

Visa O-1B
Por su parte la visa O-1B es otorgada a quienes desean residir y trabajar en los Estados Unidos con experiencia en los diferentes campos tales como: el arte, la televisión y la industria cinematográfica, lo cual debe poder demostrar, con un curriculum que así lo indique, aunado a ello deberá presentar pruebas que demuestren sin lugar a error sus habilidades extraordinarias; dado que dichas pruebas fundirían como evidencia de que efectivamente se ha obtenido algún premio o medalla en el campo específico y que quien lo está solicitando es reconocido nacional o internacionalmente en su campo.

Ahora bien, la embajada norteamericana considera cada solicitante de la visa O-1B como un caso individual, donde el primer paso del proceso de solicitud es obtener un empleo en el territorio nacional estadounidense, donde claramente su puesto u ocupación debe ser relevante por su sorprendente talento y éxito.

Aspectos a tener presentes con la obtención de la visa O-1:

  • La visa O-1 se confiere hasta por un máximo de tres años, los cuales pueden ser prorrogados en caso de ser necesario por un año más
