Obtención de Visa K-1 para Prometidos

La Visa K-1 es la forma idónea en que un ciudadano estadounidense y su prometido extranjero, puede acceder a tener una vida marital conforme a derecho, en el territorio nacional estadounidense, dado que mediante el lleno de ciertos requisitos generales y algunos específicos o particulares, los cónyuges pueden solicitar la visa de no inmigrante K-1 para quien no reside aún en los Estados Unidos. 

Es de anotar que no todas las personas que decidan o pretendan contraer nupcias, dentro del territorio estadounidense, pueden solicitarlo por el trámite que refiere la Visa K-1 dado que el solicitante debe ser ciudadano estadounidense, lo que indica que un residente no puede ser un solicitante de dicha visa, y a su vez ninguno de los cónyuges puede tener un vínculo matrimonial anterior o previo a la solicitud de la visa de prometido. 

Requisitos y Proceso de Aplicación

Por ello entonces, uno de los dos cónyuges ha estado casado en el pasado, necesitará un comprobante de divorcio o un acta de defunción que demuestre que el anterior matrimonio se encuentra disuelto en la actualidad y que por lo tanto no refiere ningún vínculo jurídico existente con otra persona, en cuanto a sociedad conyugal vigente se refiere, ello es que cualquier matrimonio anterior se encuentra a la fecha disuelto o culminado legalmente a través de una sentencia, lo que indica que se encuentra de cara a un divorcio, o el matrimonio anterior se encuentra nulo, o el matrimonio anterior se dio por terminado por la muerte del cónyuge y por ende la cesación de los efectos jurídicos que tenían lugar en razón del contrato nupcial anterior. 

Elegibilidad y Limitaciones

Ello hace referencia también a que si en algún momento los contrayentes, desean casarse en otro país, antes de realizarlo en el territorio nacional estadounidense, no podrán ser peticionarios de la visa K-1 mediante el formulario I-129F, Petición de Prometido(a) extranjero(a), el cual es el primer paso para la solicitud de La visa K-1. 

Cabe resaltar que, la ceremonia de la unión conyugal debe tener ocasión dentro de los 90 días siguientes a la entrada del prometido(a) extranjero al territorio nacional estadounidense, aunado a ello los cónyuges deben poder demostrar que la finalidad del matrimonio es de buena fe, lo cual no deja espacio para estimar otro motivo diferente al de compartir una vida en común, lo cual debe ser absolutamente comprobable. 

¿Quiénes son elegibles para aplicar a la visa k-1 de prometido?

Es de indicar que los requisitos generales son claramente un tanto comunes a quienes sean ciudadanos estadounidenses, cuyo prometido se encuentre en el extranjero, al momento de ingresar la petición contemplada en el formulario I-129F, Petición de Prometido(a) extranjero(a), ¿pero cuales entonces son los requisitos específicos y detallados para poder calificar como elegible a dicha visa? y poder beneficiarse de aspectos tan relevantes para los peticionarios, como lo es la obtención para la residencia permanente norteamericana, y en conexión directa los beneficios que acogen a los hijos del cónyuge extranjero menores de 21 años que se encuentren solteros. 

Quienes deseen aplicar a la visa K-1 de no inmigrante deberán ser novios separados que deseen realizar una vida juntos en matrimonio al interior del territorio nacional estadounidense. 

Pasos para Obtener la Visa K-1

Por lo que a continuación, enlistaremos entonces quienes y mediante qué circunstancias son elegibles para aplicar a una visa de no inmigrante K-1: 

1. Todo aquel que se encuentre soltero y sostenga una relación afectiva con fines matrimoniales con un ciudadano americano 

2. Cabe resaltar que la pareja peticionante no puede celebrar nupcias en otro país antes de ingresar la solicitud mediante formulario -129F, Petición de Prometido(a) extranjero(a), dado que evidentemente no cumplirán con el primer requisito que es ostentar un estado civil de solteros, sin sociedades conyugales vigentes a la hora de iniciar dicha petición  

3. Aunado a ello el prometido extranjero debe residir fuera de los Estados Unidos, ello es que el cónyuge extranjero no viva dentro del territorio nacional estadounidense  

4. Es de aclarar que para la visa K-1 no existen cuotas o límites en lo referente al número de personas que deseen aplicar a ella, por lo que las tarjetas verdes, o tarjetas de residencia permanente no tienen límite, dado que quienes quieran aplicar a dicha visa y claramente sean elegibles pueden dentro del proceso que ello requiere acceder a dicha visa 

5. Una visa K-1 indica entonces que se debe realizar el matrimonio dentro de los 90 días posteriores al ingreso del prometido extranjero, al territorio nacional estadounidense, por lo cual se recomienda no esperar hasta el último plazo en que está por expirar los 90 días otorgado por las leyes migratorias para llevar a cabo dicho matrimonio, dado que en derecho de migración los tiempos procesales son absolutamente sensibles , y es que, de intentar no acatar los tiempos podría incurrirse en inadmisibilidad o transgredir las leyes federales de inmigración o incurrir en errores que decantarían en tener una presencia ilegal al interior de los Estados unidos  

6. Una vez celebrado el matrimonio dentro de los 90 días conforme a las leyes federales, posterior a ello debe presentar la solicitud de la Green Car mediante un procedimiento que se determina Ajuste de Estatus  

¿Cuáles son los tres pasos principales para la obtención de la visa K1 de prometido?

1. Petición formal mediante formulario -129F, Petición de Prometido(a) extranjero(a) del prometido ciudadano estadounidense ante el USCIS, por sus siglas en inglés, el Servicio de Ciudadanía e Inmigración de Estados Unidos, quien se encarga de corroborar que efectivamente, dicha relación de pareja con fines de matrimonio existe 

2. USCIS, por sus siglas en inglés, el Servicio de Ciudadanía e Inmigración de Estados Unidos se pronuncia mediante aprobación la cual será enviada a al Centro Nacional De Visas (NVC) indicando en que consulado se está reenviando el caso en particular  

3. Lleno de requisitos, mediante el diligenciamiento de un formulario el cual se tramita en línea y se aporta el acervo probatorio que soporte dicha solicitud, sí hubiese lugar a ello, posterior a ello el consulado otorga fecha y hora para la entrevista en un consulado norteamericano, una vez surtido todo lo anterior bajo la legalidad requerida la visa K-1 será concedida al cónyuge extranjero. 

¿Qué pasos suceden a la obtención de la visa K-1?

1. Una vez recibida la visa de prometido, se cuenta con 6 meses para ingresar al territorio nacional estadounidense  

2. al cónyuge extranjero encontrarse en el puerto de entrada de los Estados Unidos, el oficial fronterizo, revisará con detenimiento toda la documentación correspondiente a la obtención de la visa K-1, durante el proceso de inspección el oficial fronterizo hará algunas preguntas correspondientes al matrimonio y su cónyuge, y este último tendrá la potestad de admitir o inadmitir al cónyuge como beneficiario de la visa K-1, sí efectivamente es admitido el pasaporte del cónyuge extranjero será sellado, otorgando los 90 días en los cuales se deberá llevar a cabo la celebración del matrimonio  

3. una vez se realice el matrimonio se debe iniciar el procedimiento de ajuste de estatus, a fin de convertirse en residente permanente, por lo que lo aconsejable es una vez se celebre el matrimonio, el cónyuge extranjero deberá comenzar a realizar todos los tramites permanentes, a fin cumplir con los tiempos por migración indicados, y de este modo evitar el incurrir en la preclusión del tiempo y con ello la perdida de la oportunidad de realizar los trámites que dan complemento a la solicitud interpuesta, dado que una vez expiren los 90 días ya no se estará autorizado para estar en el territorio nacional estadounidense 

4. Cabe resaltar que, una vez se envié la solicitud de residencia permanente, las leyes migratorias le cobijan con una protección especial que le permite permanecer de manera legal en el territorio norteamericano.
