Cómo Obtener Una Green Card a través del Matrimonio Con Un Ciudadano Estadounidense

La Green Card o certificado de residencia permanente, es para quienes desean desarrollar un proyecto de vida en los Estados Unidos, un pasaporte que les permite residir y trabajar en cualquiera de los estados que componen el territorio estadounidense, pero para obtenerla deben de estar en dicho país en calidad de residentes, lo cual a su vez refiere otra exigencia que no es otra cosa que, quien la solicite, no podrá ser nacional norteamericano, ello indica que, solo es para residentes en condición de legalidad. 

Cabe resaltar que, la Green Card o certificado de residencia, ofrece a sus titulares los mismos derechos de los cuales gozan los ciudadanos estadounidenses, lo que significa para los extranjeros el poder acceder a educación incluyendo becas universitarias, servicios de salud y los respectivos seguros, jubilación y demás beneficios que brinden los diferentes estados norteamericanos a sus nacionales. 

A continuación, estaremos enlistando las 4 diferentes maneras de adquirir la Green Card, en otras palabras, las distintas modalidades bajo las cuales se puede obtener el certificado de residencia permanente 

¿Cómo conseguir la Green Card o Residencia Permanente en los Estados Unidos?

  1. Por razones políticas: los solicitantes de asilo y los refugiados políticos pueden postularse 
  2. Por razones de inversión de capital o calidades profesionales: 
  • Sí se encuentra de frente a una inversión tenga presente que, la inversión debe ser real, lo que indica que la actividad económica debe contener una empresa o negocio legalmente constituido, al interior de los Estados Unidos, el cual refleje ingresos comprobables, dado que su estructura debe ser en todo sentido verificable, cabe mencionar que la ley indica que, la inversión debe ser sustancial, puesto que, el monto mínimo no está determinado por está, pero sí debe ser suficiente, y es que, se entiende por “sustancial” una expresión sumamente amplia, la cual no refiere una suma específica, por ello se hace necesario indicar que, la cantidad estará ajustada o determinada por la naturaleza del negocio, por lo que deberá aterrizarse en el plano de la categoría o sector en el cual se pretende ubicar la compañía y de este modo tener una cifra más cercana a la inversión a realizar, ello es que, permita crear empleo y a su vez sea autosostenible 
  • Ahora bien, si la solicitud se hace en razón de los términos de las calidades de la persona, ello refiere entonces que, la solicitud de una Green Card se realice por motivos profesionales, la norma indica que, dicha persona deberá ser una personalidad reconocida, tal como: un artista, una modelo, un científico o un atleta, entre otros muchos 
  • Otra de las razones es ser contratado por un empleador en Estados Unidos que esté de acuerdo en emplearlo y asuma a su vez el patrocinarlo para solicitar una Green card para empleados 
  1. Por lotería: cada año, los Servicios de Ciudadanía e Inmigración de los Estados Unidos (USCIS) permiten que unas 50,000 personas ganen el sésamo a través de una lotería para la obtención de la Green card 
  2. Lazos familiares: un ciudadano estadounidense mayor de edad puede solicitar la tarjeta verde para padres, hermanos, hijos y cónyuge 

Ahora bien, una de las maneras de obtener la Green card, como ya se mencionó es por lazos familiares, entre los cuales destaca el matrimonio, por lo que estaremos ampliando un poco más esta modalidad para la obtención de la Green Card a través del matrimonio con un ciudadano estadounidense. 

¿En qué consiste una tarjeta de residencia matrimonial?

Un titular de una Green card o tarjeta de residencia tendrá estatus de residente permanente hasta que, si lo desea, solicite la ciudadanía americana, para la cual será elegible después de un plazo de tres años, ahora bien, una Green card o tarjeta de residencia por matrimonio permite al cónyuge de un ciudadano estadounidense o titular de tarjeta de residencia residir y trabajar en cualquier lugar dentro del territorio nacional estadounidense. 

¿Cómo obtener una tarjeta de residencia matrimonial?

El primer paso que debe darse es establecer la relación matrimonial mediante el lleno de los requisitos del formulario I-130 dicho formulario está indicado para los cónyuges de los ciudadanos estadounidenses y de residentes permanentes (portadores de tarjeta de residencia). 

A continuación, enlistaremos los requisitos para la solicitud de una tarjeta de residencia por matrimonio peticionada mediante un formulario I-130  

Requisitos para solicitar una tarjeta de residencia por matrimonio

  • El matrimonio debe ser acreditado, por lo que se debe aportar el certificado de matrimonio, el cual deberá contener los nombres de ambos cónyuges, el lugar donde se llevó a cabo el matrimonio, y la fecha de este  
  • En caso de estar ante unas segundas nupcias, se deberá probar mediante acta de divorcio o un acta de defunción, la disolución del matrimonio previo de cualquiera de los dos cónyuges   
    • Los cónyuges deberán no solo acreditar el matrimonio, sino también probar que el matrimonio tiene fines genuinos y no se asienta en un fraude a fin de obtener un estatus legal, por lo que deberá apoyar su solicitud con acerbo probatorio tal como; un contrato de arriendo o alquiler de un inmueble en conjunto, cuentas bancarias compartidas, y fotografías juntos entre otros  
    • El ciudadano estadounidense debe obtener ingresos al menos del 125% de los lineamientos federales de pobreza 

    Tenga presente que, una vez su solicitud sea admitida usted y su cónyuge serán convocados por un oficial de inmigración cuya misión es apreciar la legitimidad de su matrimonio.  

    Si su informe es concluyente, se le entregará una tarjeta de residencia temporal.
