Invertir En Estados Unidos: ¿Qué Tipo De Visa Se Requiere Para Franquiciar Una Marca?

Al Invertir En Estados Unidos, las franquicias son a grandes rasgos importantes y muy asertivas opciones de negocio, disponibles para quienes deseen invertir un capital de dinero sustancial, toda vez que, mediante una inversión considerable, podrán usufructuarse de un negocio plenamente establecido y a su vez posicionado, el cual claramente ya cuenta con una trayectoria que se refleja en el reconocimiento de marca, por lo que una vez todo lo concerniente a la adquisición de una de ellas se encuentre en check, el franquiciante bajo una óptima administración podrá disfrutar del buen nombre de un negocio de éxito. 

Ahora bien, por el modelo de negocio que ostentan las franquicias, podría creerse que están establecidas comercial y jurídicamente solo para quienes se encuentran en  el suelo territorial que las comprende, pero nada más alejado de la realidad que eso, dado que las franquicias al interior de los Estados Unidos son una puerta abierta para el inversor que desee adquirirlas, lo cual refiere que no necesariamente quien esté interesado en adquirir una de ellas, debe obligatoriamente residir en el territorio nacional estadounidense.

Y es que las franquicias, al interior de los Estados Unidos no solo son una opción idónea de negocio y de Invertir En Estados Unidos, también ofrecen a los franquiciantes la posibilidad de poder estar vigilantes de su inversión, dado que, mediante ellas se puede obtener una visa o una tarjeta de residencia, que les permite residir en el territorio estadounidense y de este modo estar al frente de su modelo de negocio, ello también se hace extensivo a la familia del inversionista, lo cual incluye al cónyuge e hijos menores de 21 años. 

Visa EB-5

Dicho de otra manera, podría decirse entonces que, las franquicias no sólo son una opción, para los norteamericanos inversionistas o para los migrantes residentes permanentes legales o ciudadanos, también son una gran opción para  Invertir En Estados Unidos para los extranjeros que buscan obtener una green card o tarjeta de residencia a través del  programa EB-5, adicional a ello también las franquicias ofrecen la posibilidad de adquirir la facultad de residir y trabajar en los Estados Unidos temporalmente con una visa de inversión, la cual se denomina visa E-2. 

 

La visa EB-5 es una opción de inmigración que permite a los extranjeros invertir en Estados Unidos a cambio de la obtención de una Green Card, lo que significa que pueden vivir y trabajar en el país de manera permanente. Esta visa está diseñada para estimular la economía estadounidense al fomentar la inversión extranjera directa y crear empleos para los trabajadores estadounidenses.

A fin entonces de conocer un poco más lo que cada una de las visas arriba detalladas puede llegar a significar en el proceso de adquisición de una franquicia al interior del territorio estadounidense, estaremos detallando un poco más lo que refiere cada una de ellas, y las alternativas que ofrecen, cabe resaltar que no todo quien esté interesado en Invertir En Estados Unidos un capital mediante la compra de una franquicia en los Estados Unidos debe efectivamente residir en dicho territorio, puesto que ello no implica necesariamente el emigrar, pero claramente si, debe pagar impuestos en EE.UU. para lo cual se hace necesario solicitar y adquirir un número fiscal conocido como ITIN. 

 La Visas EB-5 también conocida como la visa del USD 1 M es una visa dirigida a extranjeros interesados en invertir entre $900,000 USD o $1,800,000 USD con la intención de inmigrar permanentemente a los Estados Unidos y ello refiere entonces: 

  • La Visas EB-5 tiene montos establecidos de inversión, lo cual se entrará a definir dependiendo de la naturaleza del negocio y el lugar donde se establezca, ello determina el monto mínimo a invertir, adicional a ello este tipo de visa requiere que el extranjero invierta en una entidad aprobada por los Estados Unidos, y dentro de los requerimientos, se establece que la inversión resulte en la creación de al menos 10 empleos a tiempo completo 
  • Este tipo de programa (visa EB-5) concede a los inversionistas extranjeros interesados en invertir un mínimo de 900 mil dólares, la posibilidad de adquirir  

la tarjeta de residencia para ellos y su familia 

  • Adicional a ello es pertinente indicar que, la residencia obtenida mediante la visa EB-5 permite que el inversionista, su cónyuge e hijos menores de 21 años puedan residir y trabajar en los Estados Unidos, lo cual, en principio, se otorga con carácter temporal, pero una vez pasados dos años se convierte en una tarjeta permanente que le permite estar en el territorio estadounidense de manera indefinida  
  • Uno de los requisitos que prescribe este tipo de visa es que, es necesario que efectivamente el negocio mediante el cual se va a realizar la inversión ciertamente sea real, ello es que exista y opere de acuerdo con las normas comerciales y tributarias establecidas al interior del territorio norteamericano  
  • El solicitante no puede tener ningún tipo de antecedente penal, ni en su país de origen, o en el país en que resida, lo que indica que su histórico judicial debe ser intachable  
  • Como dato a resaltar desde el 15 de octubre de 2019, embajadas y consulados pueden negar la visa a cualquier solicitante que pueda ser considerado carga pública, teniéndose en consideración factores como salud, edad e historial laboral entre otros 
  • La visa EB-5, puede ser solicitada por cualquier persona que cumpla todos los requisitos sin distinción de nacionalidad  

Visa E2 - Invertir En Estados Unidos

La visa E2 es otra opción para quienes estén interesados en realizar algún tipo de inversión mediante el modelo de negocio de las franquicias, pero en cuestión de monto un tanto más moderadas que el planteado por la visa EB-5 entre los aspectos a resaltar de la visa E2 se encuentran: 

  • La visa E-2 es una visa que opera con una vigencia de 5 años, lo que indica que pasado este tiempo se puede renovar, siempre y cuando la empresa o negocio que dio lugar a la visa inicial se encuentre operando, bien sea en las condiciones iniciales, o en un estado de crecimiento y expansión que así lo permita,  
  • El cónyuge del peticionante también podrá solicitar una visa de trabajo válidamente y de esta manera obtener un número de seguro social en los Estados Unidos, los hijos menores de 21 años del peticionante también gozan de la posibilidad de obtener visa de estudiante, cabe mencionar que dicho grupo familiar puede entrar y salir de estados unidos en el momento que a bien lo tengan 
  • Es necesario indicar que la visa E-2 es una gran alternativa para los colombianos y los ciudadanos de diversos países latinoamericanos que mediante tratados internacionales abrieron la puerta al beneficio de inversión en los Estados Unidos, entre ellos se encuentran enlistado: Argentina, Bolivia, Chile, Colombia, Costa Rica, Ecuador, Honduras, México, Panamá y Paraguay 
  • Frente al monto de la inversión, esta debe ser sustancial; ello indica que, el monto a invertir debe ser lo suficientemente robusto como para respaldar la empresa o negocio que se está adquiriendo o comenzando de cero, en este punto se tiene una especificidad y es que el valor a invertir, también lo refiere la naturaleza de la empresa o negocio, por ello entonces puede decirse que la destinación del negocio entrará a definir el monto de dicha inversión
  •  
  • El negocio o empresa debe operar físicamente, lo que indica que debe estar debidamente establecido, aunado a ello la empresa no puede ser marginal lo que indica que, no debe operar a pérdidas, ello refiere que los ingresos deben ser prósperos y suficientes 

La visa E-2 es una opción de inmigración para inversionistas extranjeros que desean invertir en Estados Unidos y desarrollar y dirigir negocios en el país. Esta visa requiere que el solicitante invierta una cantidad sustancial de capital en un negocio estadounidense existente o nuevo, y también que el negocio genere empleo para trabajadores estadounidenses. Es una opción popular para aquellos que desean invertir en Estados Unidos, pero no cumplen con los requisitos de inversión de la visa EB-5.
