El Parole Humanitario y la Reunificación Familiar son programas implementados por el Departamento de Seguridad Nacional de los Estados Unidos para ciudadanos colombianos y naturales de países como El Salvador, Honduras y Guatemala, ampliando un programa ya existente para Cuba y Haití. Estos programas permiten a los ciudadanos que ya tienen una petición del Formulario I-130 en curso esperar en los Estados Unidos para la disponibilidad de visas, agilizando significativamente el proceso de reunificación familiar.

Cambios en el Proceso de Parole Humanitario

La reunificación familiar o el parole humanitario tiene como objetivo reunir la familia, para lo cual el pasado 31 de julio de 2023, el Centro Nacional de Visas (NVC) del Departamento de Estado, comenzó a emitir invitaciones por correo electrónico y correo postal, bajo los nuevos procesos de permisos de permanencia temporal de reunificación familiar (FRP), lo que indica entonces que quienes sean elegibles pueden esperar la disponibilidad y a su vez el otorgamiento de su visa al interior del territorio norteamericano.  

Y es que, el pasado 7 de julio de 2023 el Departamento de Seguridad Nacional de los Estados Unidos, anunció la implementación de nuevos procesos con la finalidad de otorgar permisos humanitarios de reunificación familiar, a los ciudadanos colombianos y a ciudadanos naturales de los países como el Salvador, Honduras Y Guatemala, dado que, endicho programa ya se encontraban Cuba y Haití. 

Lo referido anteriormente, encuentra asidero en el marco de las medidas que se vienen gestionando al interior de los Estados Unidos para difundir y facilitar las vías regulares de migración de los ciudadanos de los países antes enlistados hacia el territorio nacional estadounidense. 

Elegibilidad y Limitantes

Ahora bien, es necesario indicar que, el beneficio de reunificación familiar o el parole humanitario de reunificación familiar, está limitada única y exclusivamente a los países arriba enlistados, adicional a ello en un principio es solo para quienes ya tienen en curso y que a su vez se encuentre aprobada la petición del formulario I-130, lo cual indica que son peticiones familiares. 

Pero a fin de tener un poco más de contexto sobre esté beneficio y sus limitantes, a continuación, estaremos detallando a manera de ejemplo cual es el escenario de quienes pueden llegar a recibir dicha invitación vía correo electrónico o postal, y es que es de resaltar que, quienes están a la espera de la aprobación de una petición sustentada en el formulario I-130, tendrán un tiempo de espera distinto, ello en razón de la calidad que se ostente al realizar la solicitud I-130. 

Proceso de Petición Familiar con Formulario I-130

Cabe indicar que, el formulario I-130 es oficialmente conocido como el medio expedito para realizar una “Petición formal ante las autoridades competentes de un Familiar Extranjero”, dicho en otras palabras, el formulario I-130 es el instrumento mediante el cual, los titulares de una green card, o lo que es igual en dicho contexto para sus efectos, un ciudadano estadounidense, puede requerir y a su vez patrocinar algunas solicitudes de permisos de residencia para sus familiares cercanos de nacionalidad extranjera, ante los Servicios de Ciudadanía e Inmigración de los Estados Unidos (USCIS). 

Ahora bien y dando continuidad a lo antes indicado, no todos los familiares de un titular de una green card, tendrán los mismos tiempos de espera con respecto a la petición y posterior aprobación frente a una solicitud tramitada mediante la puerta del formulario I-130, dado que para el cónyuge extranjero la espera es significativamente mucho más breve, que para los hermanos elegibles para dicho beneficio, puesto que pueden pasar alrededor de 13, 15 años o incluso más sin poder concluir el proceso. 

Iniciativa del Centro Nacional de Visas

Por lo que dando continuidad al ejemplo de la solicitud del formulario I-130 de petición familiar para un hermano, puede decirse que el proceso consta de dos etapas y ello es: 

  • Al realizar la petición del familiar que para este caso práctico será un hermano elegible, que se encuentra por fuera del territorio nacional estadounidense, se da comienzo a la solicitud mediante el formulario I-130, donde una vez aprobado por los Servicios de Ciudadanía e Inmigración de los Estados Unidos (USCIS) surte su primera etapa 
  •  En segundo lugar, el hermano solicitante, aun estando por fuera de los Estados Unidos le corresponde esperar a que se encuentre una visa disponible, por lo que deberá hacer parte de una muy amplia lista de espera, lo cual se puede tardar alrededor de 13 a 15 años, ahora bien, una vez se encuentra la visa disponible se surte el último proceso consular y de este modo dicho hermano ya puede viajar al país norteamericano con una residencia aprobada. 

 

Por lo que se puede inferir que, con respecto a los procesos de petición de familiar extranjero mediante el formulario I-130 ello frente a los casos de familiares como los hermanos de los ciudadanos norteamericanos, el proceso era realmente extenso en el tiempo, dado que, una vez la forma de la petición I-130 se encontraba aprobada por los Servicios de Ciudadanía e Inmigración de los Estados Unidos (USCIS) en 1 o 2 años, la espera continuaba, ello en razón de la entrada en lista de espera para la fecha de prioridad de la disponibilidad de la visa, lo cual se podía estar tardando como ya se expresó, alrededor de 13 a 15 años más.  

Por ello entonces y en aras de la reunificación familiar es que, el Centro Nacional de Visas (NVC) del Departamento de Estado, comenzó a emitir dichas invitaciones por correo electrónico y correo postal, otorgando entonces a quienes ya se encuentran en la etapa dos, ello es, en la lista de espera para la fecha de prioridad de la disponibilidad de la visa, dada la aprobación de su solicitud mediante el formulario I-130 como familiar extranjero elegible de un ciudadano norteamericano, la posibilidad de cumplir el tiempo de espera arriba detallado al interior del territorio estadounidense, donde no solo puede residir bajo la legalidad de su permiso, sino también la factibilidad de poder trabajar en los Estados Unidos. 

Glosario

Parole Humanitario: Un programa que permite a ciertos individuos ingresar o permanecer en los Estados Unidos por razones humanitarias, como la reunificación familiar. 

Reunificación Familiar: El proceso que permite a los ciudadanos estadounidenses y residentes permanentes patrocinar a ciertos familiares extranjeros para que obtengan visas y se reúnan en los Estados Unidos.
