¿Qué Hacer Para Acceder Al Proceso De Reunificación Familiar En EEUU?

Proceso de Reunificación Familiar y Parole Humanitario

Lo primero que debe de indicarse es que, quien recibe la invitación para el proceso de reunificación familiar es el ciudadano o residente permanente legal, que tenga en firme una solicitud mediante un Formulario I-130 en nombre de los posibles beneficiarios, ello es sus familiares, adicional a la solicitud, dicha petición deberá estar aprobada por los Servicios de Ciudadanía e Inmigración de los Estados Unidos (USCIS). 

Es de resaltar que, el formulario I-130 es oficialmente conocido como el medio expedito para realizar una “Petición formal ante las autoridades competentes de un Familiar Extranjero”, lo que indica que, el formulario I-130 es el instrumento mediante el cual, los titulares de una green card, o lo que es igual un ciudadano estadounidense, puede requerir y a su vez patrocinar algunas solicitudes de permisos de residencia para sus familiares cercanos de nacionalidad extranjera. 

Ahora bien, el nuevo proceso de reunificación familiar o el parole humanitario está diseñado para beneficiar, a los ciudadanos colombianos y a ciudadanos naturales de los países como el Salvador, Honduras Y Guatemala, cabe indicar que, endicho programa ya se encontraban Cuba y Haití, es de resaltar que, sólo podrán beneficiarse quienes reciban una invitación por parte del Departamento de Estado, de los Estados Unidos, al domicilio o correo electrónico que tengan referenciado en  U.S. Citizenship and Immigration Services (USCIS, por sus siglas en inglés). 

¿Pero que hacer al momento de recibir la invitación por parte del Departamento de Estado, de los Estados Unidos?

Una vez entonces llega la invitación por parte del Departamento de Estado para reunificación familiar, vía correo postal o electrónico, el peticionario debe iniciar lo antes posible el proceso de solicitud en nombre de sus familiares elegibles para ser considerado para una autorización de viaje anticipada o lo que es igual parole humanitario, lo cual tendrá lugar con el lleno del Formulario I-134A, conocido también como solicitud para convertirse en patrocinador y declarante de apoyo financiero, adicional a ello el formulario debe estar respaldado con el debido acervo probatorio, ello es, los respectivos documentos que certifique el respaldo financiero para el traslado a Estados Unidos del familiar o familiares beneficiados. 

Solicitud de permiso humanitario de permanencia temporal (parole)

Cabe resaltar que, los peticionarios solo pueden presentar el Formulario I-134A a través de su cuenta en línea de USCIS, única y exclusivamente después de recibir la invitación del Centro Nacional de Visas del Departamento de Estado. 

A continuación, estaremos detallando lo indicado por DHS, a fin de dar continuidad al proceso, lo cual esbozan de esta manera: “Si confirmamos que su formulario I-134A es suficiente, DHS completará la investigación de seguridad del beneficiario principal y de los familiares inmediatos de este, y los considerará para autorización adelantada de viaje caso por caso. Si DHS expide una autorización adelantada de viaje para el beneficiario principal y los familiares inmediatos de este, estos podrán venir a un puerto de entrada de Estados Unidos para solicitar el permiso humanitario de permanencia temporal (parole)”.  

Aunado a lo antes mencionado, indican que, si se otorga ese permiso podrá “esperar en Estados Unidos a que su visa de inmigrante esté disponible y luego presentar una solicitud para ajustar su estatus al de residente permanente legal (obtener una tarjeta de residente permanente, también conocida como Tarjeta Verde o Green Card). Los beneficiarios principales y los familiares inmediatos de estos que recibieron permiso de permanencia temporal en Estados Unidos bajo estos procesos pueden solicitar autorización de empleo o permiso de trabajo”. 

Cabe indicar que, el DHS es altamente enfático en que, “estos procesos están destinados única y exclusivamente a reunificar a los familiares beneficiarios que viven fuera de Estados Unidos con su peticionario ciudadano estadounidense o residente permanente legal que vive en Estados Unidos. Bajo estos procesos, no consideraremos para el permiso humanitario a los beneficiarios que están en Estados Unidos en el momento en que el peticionario presenta el Formulario I-134A” y reiteran que, “solo enviaremos la invitación para las peticiones que estén con el Centro Nacional de Visas del Departamento de Estado, ello si no se ha emitido una visa al beneficiario, pero se espera que una visa esté disponible pronto”. 

A la luz de lo antes detallado, se puede inferir que, solo ciertos peticionarios cuyo Formulario I-130 ya está aprobado recibirán la correspondiente invitación para presentar el Formulario I-134A a nombre del beneficiario principal y los familiares inmediatos de este, y es que el DHS al realizar su anuncio refirió que, alrededor de 73.000 personas de Colombia, El Salvador, Guatemala y Honduras podrían beneficiarse del nuevo proceso de reunificación familiar.
