Residencia Permanente o Green Card A Través De Empleo

La residencia permanente o green card a través de empleo, claramente abre las puertas a los extranjeros que quieren o necesitan expandir sus conocimientos o talentos extraordinarios a Estados Unidos  

Los Estados Unidos ofrece mediante sus leyes de inmigración la posibilidad a los extranjeros de hacerse residentes permanentes legales, lo cual refiere la obtención de la residencia o Tarjeta Verde, ello indica que la residencia puede obtenerse a través de un permiso de trabajo dentro del territorio estadounidense. 

Este tipo de residencia permanente no refiere el tener que hacer grandes inversiones económicas dado que está enfocada a los talentos y habilidades reconocidas nacional o internacionalmente, pero claramente demostrables

Categorías de Residencia Permanente a través de Empleo

A continuación, enlistaremos las categorías que incluyen una residencia permanente legal a través de un empleo para “inmigrante preferencia” (EB)

  • (EB-1) primera preferencia, lo cual incluye a los trabajadores prioritarios: lo cual refiere a los extranjeros con aptitudes extraordinarias en las ciencias, las artes, la educación, los negocios, o los deportes, al igual que a los profesores e investigadores sobresalientes y algunos ejecutivos o gerentes de una multinacional 

Y es que, la inmigración basada en un empleo de Primera preferencia EB-1 está diseñada para beneficiar a extranjeros que posean una aptitud extraordinaria y demostrable, por ello cada categorías arriba enlistadas deben cumplir con los siguientes requisitos:  

Aptitud extraordinaria: quien quiera solicitarla deberá demostrar que tiene alguna aptitud extraordinaria en las ciencias, artes, educación, negocios o deportes a través del reconocimiento continuo nacional o internacional, ahora bien, el solicitante debe cumplir con por lo menos tres de los diez criterios* (los cuales se estarán enlistando más adelante), o facilitar pruebas de algún logro obtenido en una sola ocasión (por ejemplo: Pulitzer, Oscar, medalla olímpica), así como evidencia que demuestre que aún trabaja en el área de experiencia, cabe resaltar que no se requiere una oferta de empleo o certificación laboral. 

Profesores e investigadores sobresalientes: quien quiera solicitarla deberá demostrar que se ha ganado el reconocimiento internacional con sus destacados logros en un campo académico particular. Deberá tener al menos tres años de experiencia en la docencia o en la investigación en esa área académica. La razón para entrar a los Estados Unidos deberá ser la búsqueda de una titularidad o de un puesto de profesor titular o de un puesto investigativo similar en una universidad, institución de educación superior o empleador privado. 

Aunado a ello debe cumplir con por lo menos dos de los seis criterios que se mencionan más adelante** y proporcionar una oferta de empleo de su futuro empleador en los Estados Unidos. El empleador privado debe demostrar logros que estén documentados y que emplea por lo menos a 3 investigadores a tiempo completo. No se requiere una certificación laboral. 

Ejecutivo o gerente de una multinacional: quien quiera solicitarla deberá haber estado empleado fuera de Estados Unidos durante al menos un año de los tres años anteriores a la petición o de la más reciente admisión legal de no inmigrante si usted ya trabaja para el empleador estadounidense peticionario. El peticionario estadounidense debe haber realizado negocios durante al menos un año, tener una relación cualificada con la entidad para la que usted trabajó fuera de Estados Unidos, y tener la intención de emplearlo a usted a nivel gerencial o ejecutivo. 

Criterios para solicitar una Residencia Permanente a través de Empleo

Cabe resaltar que el empleador que hace la petición tiene que ser un empleador estadounidense y tener la intención de emplear al peticionante a nivel gerencial o ejecutivo. El empleador tiene que haber estado haciendo negocios durante al menos un año, como un afiliado legal de la entidad que lo empleó al peticionante en el extranjero en capacidad gerencial o ejecutiva, para lo cual no se requiere una certificación laboral. 

Criterios para demostrar que se tiene alguna aptitud extraordinaria

  • Prueba de que recibió premios o galardones a la excelencia al menos reconocidos nacional o internacionalmente 
  • Prueba de su membresía en asociaciones en su campo que exijan que sus miembros obtengan logros destacados 
  • Prueba de materiales publicados sobre usted en publicaciones profesionales o en publicaciones comerciales importantes o en otros medios de comunicación importantes 
  • Prueba de que se le ha pedido que juzgue el trabajo de otras personas, ya sea individualmente o como parte de un panel 
  • Prueba de sus contribuciones científicas, artísticas, en el campo académico, en los deportes o en relación con los negocios de notable importancia en su campo 
  • Prueba de autoría de artículos académicos aparecidos en publicaciones profesionales o en publicaciones comerciales importantes o en otros medios de comunicación importantes 
  • Prueba de que su trabajo se ha exhibido en exposiciones o muestras artísticas 
  • Prueba de su desempeño en un papel principal o de suma importancia en organizaciones distinguidas 
  • Prueba de que usted cuenta con un salario alto o con alguna otra remuneración notablemente alta en comparación con otras personas en su campo 
  • Prueba de sus éxitos comerciales en las artes escénicas 

**Ejemplos de evidencias de que la persona es un profesor o investigador destacado

Para demostrar que usted es un profesor o investigador destacado, debe incluir evidencia de dos de los seis criterios indicados a continuación (o evidencia comparable si alguno de los criterios no aplica fácilmente): 

  • Prueba de que ha recibido premios o galardones importantes por sus destacados logros 
  • Prueba de su membresía en asociaciones que exijan que sus miembros obtengan logros destacados 
  • Prueba de material publicado en publicaciones profesionales escrito por otros sobre el trabajo del extranjero en el campo académico 
  • Prueba de su participación, ya sea en un panel o individualmente, como juez del trabajo de otros en el mismo campo académico o en un campo relacionado 
  • Prueba de contribuciones investigativas científicas o académicas originales en su campo 
  • Prueba de autoría de libros o artículos académicos (en publicaciones académicas de circulación internacional) en su campo 

Segunda preferencia (EB-2) – extranjeros que son miembros de las profesiones que requieren un posgrado o tienen una aptitud excepcional (incluidas las solicitudes para una exención por interés nacional).
